These Terms of Service (the "Terms") govern your use of the mobile application "BASKETALLY" (the "App") provided by yukitaka13 ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.
01Acceptance of Terms
By using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree, do not use the App. How we handle information in the App is described in our separate Privacy Policy.
02Eligibility
You must be at least 13 years old (or 16 in the EEA) to use the App. Minors must obtain consent from a parent or legal guardian.
03Features
The App lets you record basketball games, manage your team and players, add players by reading a roster sheet photo, view statistics, save and sync records to the cloud, and send bug reports with "Send feedback". When you read a roster sheet, the photo (including photos of opponents' rosters) is sent to Google LLC (see the Privacy Policy for details).
04License
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App in accordance with these Terms and the applicable App Store / Google Play license terms.
05Account
- You sign in to the App with your Google or Apple account.
- One account manages one team.
- You are responsible for keeping your account secure and must not let others use it.
- You may delete your account at any time from Settings → Delete account in the App. When you delete your account, your team, player, and game data stored on our servers, messages you sent with "Send feedback", your sign-in information, and the records on the device you used to delete the account are deleted and cannot be restored.
- Usage logs and crash information (which contain no names) are kept after you delete your account until the end of the retention periods in the Privacy Policy.
06Data You Enter
- You or the rightful owners retain the rights to team, player, and game data, photos, and other data you enter in the App ("Your Data").
- You grant us permission to store, copy, transmit, and process Your Data to the extent necessary to provide the App.
- When you enter information about other people, such as player names or photos, you are responsible for handling it appropriately, including obtaining the understanding of the person (or their parent or guardian if the person is a minor) where appropriate. Enter names or photos of opponent players only as far as needed to record the game.
- We do not make the names or photos of players, coaches, or teams in Your Data public without your consent.
07Data Storage
- We make efforts to prevent loss of Your Data, but we cannot completely rule out loss due to device failure, network problems, bugs in the App, or other causes.
- Our servers store Your Data as of the last time you synced. Data you have not synced exists only on your device.
08Test Distribution
- Before general release, we may distribute the App on a trial basis through TestFlight or similar means ("Test Distribution").
- During Test Distribution, features and screens may change without notice.
- Usage logs and feedback collected during Test Distribution are used to improve the App.
09Fees
The App is provided free of charge. The App does not display advertisements and does not offer in-app purchases. You are responsible for any data charges incurred when using the App.
10Prohibited Conduct
You agree not to:
- Violate any applicable law or regulation;
- Engage in any illegal activity;
- Interfere with or disrupt the operation of the App;
- Infringe the rights of other users or third parties (including entering another person's name or photo against their wishes);
- Reverse engineer, decompile, or modify the App;
- Access our servers without authorization or place excessive load on them;
- Let others use your account;
- Engage in any other conduct we deem inappropriate.
11Intellectual Property
All copyrights, trademarks, and other intellectual property rights in the App and its content (excluding Your Data) are owned by us or our licensors. You may not reproduce, distribute, modify, or create derivative works without prior written permission.
12Suspension of Use
If you violate these Terms, we may suspend your use of the App or delete your account without prior notice.
13Modification, Suspension, or Termination of Service
We may, at our sole discretion and with or without prior notice, modify, suspend, or terminate the App or any of its features. We are not liable for any resulting damages. If we terminate the cloud storage feature, we will provide reasonable advance notice.
14Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE EXTENT PERMITTED BY APPLICABLE LAW. We do not warrant that the App will be uninterrupted, error-free, or free from harmful components, or that statistics calculated by the App are accurate.
15Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App, except in cases of our willful misconduct or gross negligence.
Nothing in these Terms limits liability that cannot be limited under applicable law.
16Third-Party Services
The App uses third-party services (e.g., Google, Apple, Amazon Web Services). We are not responsible for the content, policies, or practices of such third parties, or for damages caused by their outages or changes.
17Changes to These Terms
We may revise these Terms at any time. Material changes will be notified through the App or our website. Continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes.
18Governing Law and Jurisdiction
These Terms are governed by the laws of Japan, without regard to conflict-of-laws principles. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Japan having jurisdiction over the location of yukitaka13, except where mandatory consumer protection laws of your country of residence apply.
